All members of the public wishing to address the City Council, Redevelopment Agency and Novato Public Finance Authority are requested to submit a speaker card in advance to the City Clerk. The Mayor will call the names of speakers from the cards. Anyone wishing to speak on any item on the agenda other than those listed under Public Hearings (Section I) will be recognized at this time or at the time the item is heard. There is a three minute time limit. Items brought up during Public Comments that are not on the agenda can legally have no action. The City Council, Redevelopment Agency and Novato Public Finance Authority may direct that the item be referred to the City Manager for administrative action or may schedule the item on a subsequent agenda.

            1.         PAVILIONS AT THE WATERFALL TERRACE OFFICE PROJECT

 

Consider second reading and adoption of an ordinance amending the Novato Creek Landing Master Plan text in accordance with the requirements of the City of Novato Municipal Code, Chapter XIX, and the conservation and planning law of the State of California for the Pavilions at Waterfall Terrace office project.

 

Recommendation: Adopt ordinance.

 

            2.         MULTI-FAMILY GREEN BUILDING ORDINANCE

 

Consider second reading and adoption of an ordinance providing requirement to submit and comply with green building measures on multifamily projects within the City of Novato.

 

Recommendation: Adopt ordinance.

 

            3.         CONFIRMATION OF THE DECISIONS MADE AT THE WORKSHOP

ON COMMISSIONS, COMMITTEES AND BOARDS (CCBs)

 

                        a.         Consider adopting resolutions rescinding and restating the duties of the Citizens Budget Committee, Economic Development Commission and Street Improvement Oversight Committee to add “Advisory” to their titles.

 

                        b.         Consider adopting a resolution rescinding Resolutions 179-02, Bicycle/Pedestrian Advisory Committee, 82-03, Commissions on Drugs & Alcohol, 77-05, Civic Arts Commissions, 116-05, Multi-Cultural Commission, 117-05, Community Strategic Plan Oversight Committee and 45-07, Housing & Services Commission.

 

Recommendation: Adopt resolutions.

 

            4.         CONFIRM DESIGN REVIEW COMMITTEE NAME CHANGE

 

Consider adopting an ordinance amending Section 2-11 of the Novato Municipal Code to change the name of the Design Review Committee to the Design Review Commission.

 

Recommendation: Introduce ordinance.

 

            5.         RESCINDING SECTION 2-14, PARKS & RECREATION ADVISORY COMMISSION

 

Consider introducing an ordinance rescinding Section 2-14, Parks & Recreation Advisory Commission, of the Novato Municipal Code.

 

Recommendation: Introduce ordinance.

 

            6.         HOUSING & BUILDING CODES APPEALS BOARD NAME CHANGE

 

Consider introducing an ordinance amending Section 4-1.5 of the Novato Municipal Code, to change the name of the Housing & Building Codes Appeals Board to “Housing, Zoning and Building Codes Appeals Board.”

 

Recommendation: Introduce ordinance.

 

            7.         RECREATION, CULTURAL, AND COMMUNITY SERVICES ADVISORY COMMISSION

 

Consider adopting resolution establishing new commission.

 

Recommendation: Adopt resolution.

 

            8.         ADOPTION OF AN EXCEPTION TO THE CITY OF NOVATO INVESTMENT POLICY

 

Consider adopting a resolution approving an exemption to the Investment Policy to allow the Hamilton Trust Fund to purchase securities which have a term or remaining maturity at the time of investment in excess of five years.

 

Recommendation: Adopt resolution.

 

            9.         CITY OF NOVATO INVESTMENT POLICY

 

Consider adopting a resolution approving the Investment Policy for fiscal year 2007/08.

            10.       CITY MANAGER’S PERFORMANCE PAY

 

Consider approving $5,000 in performance pay to the City Manager.

            11.       AMENDMENT TO THE FEE RESOLUTION

 

Consider adopting resolution to amend Fee Resolution #48-06 and approve the following proposed fee changes:

 

a.eliminate fee for release of crime reports

b.increase fee for release of collision reports from $15 to $20.

            12.       U.S. MAYORS’ CLIMATE PROTECTION AGREEMENT

 

Consider adopting a resolution endorsing the U.S. Mayors’ Climate Protection Agreement.

            13.       SAFE ROUTES TO SCHOOL SAFETY IMPROVEMENTS PROJECT, CIP PROJECT NO. 07-008

 

Consider awarding a construction contract to the lowest responsible bidder, J.A. Gonsalves & Son Construction, Inc., in the amount of $132,000 , plus ten percent (10%) contingency of $ 13,200, totaling $ 145,200, to construct the Safe Routes to School Safety Improvements Project, CIP Project No. 07-008.

 

Recommendation: Award contract to J.A. Gonsalves & Son Construction, Inc.
